CARBONDALE (WSIL) -- The City of Carbondale followed through on its warnings regarding ticketing bars and restaurants found violating Governor Pritzker's executive order on indoor dining.

The City passed an ordinance in early April providing penalties for up to $750 a day, for "" the Governor's executive order.

Mary Lou's Grill is one of five restaurants in Carbondale issued tickets this week for violating the indoor-dining restrictions.

The restaurant posted a picture of their ticket to their Facebook page Thursday morning, informing customers they would be open for "Carry-Out Only."

News 3 spoke with Mary Lou's owner who says while they have received warnings on seating diners, they cannot survive on "just to-go orders."

"We're trying to survive and here, we got that, and of course starting tomorrow the Health Department could come in and say, whether we're violating an ordinance now," says owner Marilyn Martin. "So, we're going to fight this battle."

Martin adds other restaurants are joining their efforts to fight the City of Carbondale on these tickets. They are meeting with their lawyer next week to discuss their option.

The City of Carbondale issued a statement Thursday afternoon saying, "efforts to gain voluntary compliance have been notably successful," but in some cases, they say ticketing has become unavoidable.
