Why was he free? A look at murder suspect’s previous shooting case

(WSIL) -- Many in southern Illinois and across social media are asking why a Harrisburg man now was out on the streets.

He's still on the run after being accused of shooting a teen in the head.

We've been (AKA McWilliams) criminal past.

Court documents obtained by News 3 WSIL on Friday give a glimpse into a previous .

That July, prosecutors filed two charges against McWilliams--attempted murder and aggravated battery.

They say he shot a man, at a Harrisburg home, with the intent to kill him.

More than a year later, McWilliams' lawyer asked for the charges to be thrown out.

Seven pages of documents, filed in Nov. 2019, accuse prosecutors of withholding evidence including contradictory statements from key witnesses during police interviews and a lack of blood evidence at the scene.

The defense says that evidence could have benefitted McWilliams' case.

On April 29, 2020, prosecutors filed a third charge of obstructing justice.

Court records show on that same day McWilliams agreed to a plea deal and all other charges were dropped.

WHY WAS HE OUT?

A judge sentenced McWilliams to three years in Menard Correctional Center. Records show he was to serve 50 percent of that sentence.

He got credit for more than a year of time (385 days) already served while the case made its way through the court system.

Illinois Department of Corrections records show McWilliams got out on parole last October after just seven weeks inside the facility.
